Rather than bifurcating the term “sanitation,” as the lower court did, into either “cleanliness” or the “promotion of cleanliness in public health activities,” a more nuanced and knowledgeable basis of scientific history might have cleared up the impasse and given greater guidance (and powers) for CDC to act during COVID and future epidemics.
